These Terms are a contract between you and Chopped or Not, ("we", "us"), covering your use of the Chopped or Not mobile app and its services (the "App"). By tapping through the sign-in screen, you agree to them. If you do not agree, do not use the App.

Our Privacy Policy explains what we collect and why, and forms part of these Terms.

1. What the App is

You take one photo of yourself in the App. Strangers respond 🔥 (liked) or 😑 (meh). You see the counts, and — with a subscription — how different groups responded.

Chopped or Not is not a dating app, and not an introduction service. There are no names, no profiles, no messaging, no comments, no matching and no way for one user to identify or contact another. Do not use it expecting any of those.

2. You must be 18 or older

The App is for adults only. You must be at least 18 years old to create an account or to use the App in any way.

We ask for your date of birth at sign-up. If you are under 18, your account and everything in it is deleted and you are signed out. Misrepresenting your age is a breach of these Terms, and we will terminate any account we believe belongs to a minor.

3. Your account

• You sign in with your Apple ID or with a Google account. You are responsible for keeping access to whichever you used; anyone who controls it controls your account.
• One person, one account. Do not create accounts on behalf of anyone else.
• You may sign out at any time without losing anything, or delete your account and all of its data at any time in Settings.
• Standard message and data rates from your carrier may apply to sign-in codes.

4. Rules for photos: the ones that actually matter

The App is built so that a photo can only be taken live, in the App. There is no camera-roll import, and there never will be. That control exists to make the following rules enforceable, and they are not negotiable.

You may only post a photo of yourself.

You must not post:

• A photo of any other person, with or without their permission, including in the background of your own photo where they are identifiable.
• A photo of anyone under 18, in any context, ever. This is grounds for an immediate permanent ban and, where applicable, a report to the relevant authorities.
• Nudity, sexual content, or anything explicit.
• Violence, gore, or content designed to shock or disturb.
• Hate symbols, or content attacking people on the basis of a protected characteristic.
• A photo of a screen, a printed photograph, a picture of a picture, a drawing, a rendering, or anything that is not a live photograph of you.
• Anything illegal, or anything that infringes someone else's rights.
• Text, handles, links, contact details, or anything else written or held up in frame intended to identify you or to move a conversation off the App.

You must also not:

• Attempt to identify, contact, track, or deanonymise any other user.
• Attempt to obtain voter identities, or to reverse-engineer individual answers out of the statistics the App publishes.
• Automate, script, or otherwise fake voting, posting, or account creation; or circumvent the App's rate limits.
• Copy, save, redistribute, or republish another user's photo anywhere, by any means.
• Probe, scan, overload, or interfere with the service or its infrastructure, or attempt to access data you are not entitled to.

5. Your photo, and what we do with it

You keep ownership of your photo. You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, resize, transmit, and display your photo inside the App to other users, for as long as you keep it live, and to process it for the automated moderation described below. That licence is solely for operating the App.

We do not sell your photo, licence it to third parties, use it in advertising, or use it to train models. It is shown inside the App and nowhere else.

When you take a photo down it stops being served to anyone immediately. When you delete a photo, or your account, the image is deleted from storage. See the Privacy Policy for the detail.

6. Moderation, reporting and takedown

• Every photo is scanned automatically before anyone can see it. It is not served to any other user until that check approves it. If the check cannot be completed, the photo stays unpublished and is never served — the gate fails closed.
• You can report any photo you are shown, choosing from: inappropriate; not a real person; someone else's photo; other. Reporting removes that photo from your feed at once and sends it to us for review.
• We may remove any photo, at any time, at our discretion, with or without notice, if we believe it breaks these Terms or is otherwise harmful. We are not obliged to review every photo beyond the automated check, and moderation is not perfect: automated systems produce false positives and false negatives.
• We may suspend or permanently ban an account that breaks these Terms. A banned account cannot post or vote, and its photos stop being shown.
• If a photo of you was posted by someone else, write to choppedornotapp@gmail.com and we will remove it. Include enough detail for us to identify it. We treat this as urgent.
• Nothing here obliges us to keep any content, and we may delete content that breaks these Terms without preserving a copy for you.

7. Subscription

The App is free to use. Swiping, posting, and the raw counts on your own photo are free forever. A single optional subscription unlocks the analytics: who liked you by age, gender and ethnicity; where they are; your biggest fans; and stats for every photo you post.

• Price: $9.99 per month, or the equivalent in your local currency as shown in the App at the time of purchase. The price shown by the App Store or Google Play at the moment you buy is the price that applies.
• Auto-renewal: the subscription renews automatically each month until you cancel. Your account is charged for renewal within 24 hours before the end of the current period.
• Cancelling: you can cancel any time from your Apple ID or Google Play account settings — Settings in the App links straight there. Cancelling turns off auto-renewal; you keep access for the rest of the period you have already paid for. Deleting the App does not cancel a subscription.
• Payment: all payments are processed by Apple (or Google), not by us. We never see your payment details.
• Refunds are handled by Apple or Google under their own policies, not by us. We cannot issue a refund for a store purchase.
• Restoring: "Restore purchase" in the App re-checks your entitlement with the store.
• We may change the price. Any change applies from the start of a renewal period, after notice given as the app stores require, and you can cancel before it takes effect.
• What the subscription is not: it does not buy you visibility, priority in anyone's feed, control over who sees your photo, more votes, names, or the ability to contact anyone. It only unlocks statistics about your own photos.

8. Statistics are aggregate, and deliberately limited

The analytics the App shows are aggregate counts subject to a strict minimum group size: no figure is published that describes fewer than 20 people, and breakdowns are released in fixed 20-vote steps. This is a privacy control for voters and it is not adjustable. You agree not to attempt to defeat it, and you accept that a photo may show no breakdown at all until enough people have answered.

Counts are what real users did. We do not seed, simulate, buy, or inflate votes, and we do not provide any way for you to do so either.

9. Availability

We provide the App "as is". We may change, suspend, or discontinue any part of it, temporarily or permanently, with or without notice. We do not guarantee that the App will be available, uninterrupted, error-free, or that any photo, count, or statistic will be preserved. Keep your own copy of anything you care about — though note that the App itself cannot save photos back to your device.

10. Termination

You may stop using the App at any time and may delete your account and all of its data in one tap in Settings.

We may suspend or terminate your account immediately, without notice, if we believe you have broken these Terms, or where we must do so for legal or safety reasons. Sections 5 (the licence, as to content already distributed within the App), 8, and 11 through 15 survive termination.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

In particular, we do not warrant that moderation will catch every prohibited photo, that no user will ever break these Terms, or that the App will be free of content you find objectionable.

The App is entertainment. Votes are strangers' snap reactions to a photograph. They are not an assessment of your worth, and nothing in the App is advice of any kind — medical, psychological, or otherwise. If you are struggling with how you feel about your appearance, please talk to someone qualified.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR EMOTIONAL DISTRESS, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) US $50.

Some jurisdictions do not allow these limitations, so they may not fully apply to you. Nothing in these Terms limits liability that cannot be limited by law.

13. Indemnity

You agree to indemnify and hold us harmless from any claim, demand, loss or expense (including reasonable legal fees) arising from a photo you posted, your use of the App, or your breach of these Terms — in particular any claim brought by a person who appears in a photo you posted.

14. Changes to these Terms

We may update these Terms. We will update the "Last updated" date, and for material changes we will notify you in the App. Continuing to use the App after a change takes effect means you accept the revised Terms. If you do not accept them, delete your account.

15. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the courts located in the State of California, except that either party may seek injunctive relief in any court of competent jurisdiction.

Disputes are resolved in the state or federal courts of California. There is no mandatory arbitration clause and no class-action waiver.

16. Apple App Store terms

These additional terms apply when you obtain the App from Apple's App Store:

• These Terms are between you and us only, not with Apple. We, not Apple, are solely responsible for the App and its content.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• We, not Apple, are responsible for addressing any claim by you or a third party relating to the App, including product liability, failure to conform to legal requirements, and consumer protection or privacy claims.
• We, not Apple, are responsible for investigating and defending any third-party claim that the App infringes intellectual property rights.
• You represent that you are not located in a country subject to a US Government embargo or designated as "terrorist supporting", and that you are not on any US Government restricted-parties list.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• Your use of the App must also comply with the App Store Terms of Service.

17. General

• Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the App.
• Severability. If any provision is unenforceable, the rest stays in force.
• No waiver. Not enforcing a provision does not waive it.
• Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
